Sean Wallis recently obtained a complete summary judgment dismissal on behalf of a Texas residential homebuilder in a personal injury lawsuit arising from a motor vehicle collision. The plaintiff sought to hold our client liable under theories of negligence and respondeat superior, alleging the driver was acting within the course and scope of employment at the time of the crash. Through targeted summary judgment practice, we established that the driver was never under our client’s control. The court agreed that the plaintiff could not establish an employment relationship or right of control needed to impose liability on our client, and dismissed all claims as a matter of law
